What is building law?
The term building law includes all regulations and standards that affect construction. At a first level, building law can be divided into private and public building law. Private building law deals with the legal relationships of the private parties involved in construction, i.e. the clients and the contractors who plan and carry out the construction. Private building law is essentially construction contract law.
Public building law deals with the legal relationships and documents between the administration and the builders or owners. In a second level, public building law can be divided into building planning law and building regulations law. While building planning law is essentially uniform across the country, there are different regulations for building regulations law in the respective federal states.
Overview of relevant standards of construction law and construction contract law:
- Building Code (BauGB),
- Building regulations of the states (including BauO Berlin)
- Regulation on the structural use of land (BauNVO)
- Neighborhood law of the states (including Berlin Neighbor Law)
- Contract law in the German Civil Code (§§ 631 ff. BGB)
